ORDER: 1) The Clerk of the Court is directed to send a copy of the Petition 1 and this Order to Jason Maydak, Jailer at the Boone County Detention Center, and to the United States Attorney's Office for the Eastern District of Kentucky. 2) Within 14 days from the entry of this Order, the United States Attorneys Office for the Eastern District of Kentucky and Jason Maydak are directed to file a response to the Petition. The United States Attorney's Office's response should be in the form of a memorandum addressing the factual allegations and legal claims contained in the pleading. Jason Maydak may respond with a memorandum indicating whether he adopts the United States Attorney's Office's response in whole or in part, and he may raise additional arguments as he deems fit. Neither a formal motion to dismiss nor a motion for summary judgment is appropriate for these proceedings. The Respondents also should attach any relevant documentary evidence to their response briefs. 3) Once the Respondents file their response(s), the Petitioner may file a reply within 14 days.
