Petitioner requests this Court issue a writ ordering Petitioner's immediate release. If Petitioner seeks emergency relief and intends to file a motion for a temporary restraining order ("TRO"), Petitioner shall file the motion as soon as possible and no later than two (2) court days from the date of this order. If Petitioner does not intend to file a TRO, Petitioner shall notify the Court immediately at mkrueger@caed.uscourts.gov. Pending the Court's ruling on the petition, Respondents shall not take any action to transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (acknowledging the Court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). MINUTE ORDER signed by Magistrate Judge Jeremy D. Peterson on 4/27/2026: The court has reviewed the petition for writ of habeas corpus, ECF No. 1, and respondents' opposition, ECF No. 9 . The court orders the parties to file supplemental briefing as follows. The parties agree that petitioner was convicted under California Health and Safety Code § 11351. The parties also agree that petitioner received some post-conviction relief; petitioner alleges that his conviction was vacated under California Penal Code § 1473.7(a)(1), while respondents state that petitioner's sentence was vacated. However, there is no evidence in the record identifying the relief that petitioner was granted, or the superior court's reasoning for providing such relief. Accordingly, the parties are hereby ORDERED to simultaneously file supplemental briefing by 5/4/2026 that addresses what post-conviction relief petitioner has been provided and whether, for immigration purposes, petitioner remains convicted under California Health and Safety Code § 11351.
