MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 5/8/2026. Petitioner Hector Arturo Valerio Nino filed a reply in support of his habeas petition asserting that the "immigration court dismissed [his] removal proceedings" and asserting that, since "there are no formal charges of removal against [him], he should be immediately released without condition[s]." 10 As support, Nino attaches a screenshot of DHS's Automated Case Information website, which reflects that "the immigration judge ordered DISMISSAL" on April 4, 2026. This screenshot is insufficient to conclude that Nino has no pending matters before the immigration court. The respondents are HEREBY ORDERED to file a supplemental brief explaining the status of Nino's immigration proceedings, whether he remains detained, and under what authority, by noon on May 12, 2026. The respondents must attach any exhibits--including the immigration court's April 14, 2026, order--that it relies on to support the facts in its supplemental brief. (Copies have been distributed pursuant to the NEF - MH) (Entered: 05/08/2026)
