ORDER TO SHOW CAUSE: The Court is in receipt of Petitioner's petition for a writ of habeas corpus 1, in which Petitioner argues that he has been unlawfully detained at the Norwest Detention Center, located in Tacoma, Washington, since January 2025. Under 28 U.S.C. § 2241(a), district courts are limited to granting habeas relief "within their respective jurisdictions." When interpreting this language, the Supreme Court has held that habeas petitions challenging present physical confinement may be brought in "one district: the district of confinement." Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004). And, it is equally well settled that proper venue for adjudicating a habeas corpus petition lies in the district of confinement. Moussaoui v. Biden, No. 25-CV-0691 (JGK), 2025 WL 457804, at *1 (S.D.N.Y. Jan. 28, 2025) (collecting cases). As such, Petitioner is directed to SHOW CAUSE, no later than 5 p.m. on April 7, 2026, why his Petition should not be transferred to the United States District Court for the Western District of Washington, which is the district court overseeing the Petitioner's district of confinement.
