MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 5/15/2026. By Judicial Assistant: E. Santiago.Pending before the Court is the Motion to Withdraw as Attorney. ECF No. 10 filed on April 30, 2026. No response to the Motion was timely filed. Mr. Jacobs provides the Court with good cause of the withdrawal he seeks. Specifically, Petitioner informed his counsel, Michael Jacobs ("Jacobs") he no longer wishes to be represented by him and there has been a breakdown in communication such that Petitioner has falsely accused Jacobs of failing to file a habeas corpus petition on Petitioner's behalf even though Jacobs provided Petitioner with the case number and relevant filings. Under Local Rule IA 11-6 and Nevada Rule of Professional Conduct 1.16(a)(3) the Court finds good cause for withdrawal. See also Nev. R. Prof. Cond. 1.16(d). Jacobs further explains that he is aware that Petitioner is Ordered to Show Cause in writing why this case is not moot by April 30, 2026. Jacobs agrees that Petitioner's case is moot, but does not believe he can ethically provide a response when Petitioner no longer wants his services. The Court agrees.Accordingly, IT IS HEREBY ORDERED that the Motion to Withdraw as Attorney (ECF No. 10 ) is GRANTED.IT IS FURTHER ORDERED that, based on withdrawal of counsel, the Court sua sponte grants Petitioner an extension through and including May 29, 2026 to respond to the Order to Show Cause. IT IS FURTHER ORDERED that Petitioner is, no later than May 29, 2026, to provide an address and, if available, email address and telephone number, to which the Court can send future communications. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 7/16/2026.Before the Court is Mr. Cesar Andres Gomez Calderon's First Amended Petition for Writ of Habeas Corpus (ECF No. 17 ). The Court has reviewed the Petition, as well as Respondents' prior filing regarding Class Membership (ECF No. 5 ), and preliminarily finds that Mr. Calderon may be entitled to habeas relief under: (i.) Jacobo Ramirez v. Mullin, --- F. Supp. 3d ---, 2026 WL 879799 (D. Nev. Mar. 30, 2026); (ii.) the Immigration and Nationality Act; and (iii.) the Due Process Clause of the Fifth Amendment.Therefore, Respondents are ORDERED TO SHOW CAUSE for Petitioner's detention. See 28 U.S.C.§ 2243. Specifically, Respondents must file a "return certifying the true cause of detention" on or before July 20, 2026. In doing so, Respondents should not re-argue their faulty interpretation of 8 U.S.C. § 1225(b)(2)(A), as this issue has already been litigated in, and decided by, this Court. See generally Jacobo Ramirez, 2026 WL 879799 (D. Nev. Mar. 30, 2026). With that being said, Respondents may reference their prior briefing on this issue for appellate purposes. Finally, if Respondents intend to rely on a separate source of detention authority, they must identify it in their return.IT IS FURTHER ORDERED Respondents must file a supplement that answers the following interrogatories under oath, see Rule 7, Rules Governing § 2254 Proceedings in the United States District Courts: (1.) Was Petitioner arrested pursuant to a lawfully executed, and served, administrative warrant pursuant to 8 C.F.R. § 236.1(b)? (2.) Was an initial custody determination conducted as to Petitioner pursuant to 8 C.F.R. § 236.1(c)(8)? (3.) Was a Form I-286 Notice of Custody Determination served on Petitioner pursuant to 8 C.F.R. § 236.1(g)?
