ORDER re: 1 Emergency PETITION for Writ of Habeas Corpus filed by Bessy Liliana Ramos Contreras. To give the Court time to consider the pending petition, unless otherwise ordered by the Court, the petitioner shall not be moved outside the District of Rhode Island without providing the Court with at least 72 hours advance notice of the move and the reason therefore. TEXT ORDER: Before the Court is Petitioner's Petition for Writ of Habeas Corpus ("Petition") (ECF No. 1 ), Respondents' Motion to Dismiss/Transfer to the District of Massachusetts (ECF No. 6 ), and Petitioner's Emergency Motion to Release (ECF No. 7 ). The Court held a hearing at 1:00pm today and heard argument from both parties. Petitioner's physical location since her detention on March 31 has been unclear, resulting in inconsistent information filed in this case as well as in the Petitioner's habeas case pending in the District of Massachusetts (1:26-cv-11523). Because all parties believed Petitioner to be located in Rhode Island at the time the initial Petition was filed, the Court concludes it may exercise jurisdiction over the Petition and pending motions. The Respondents' Motion to Dismiss or Transfer is DENIED. As stated during the hearing, the Petition for Writ of Habeas is GRANTED. The Emergency Motion for Release is GRANTED. The Court ORDERS the Government to release Petitioner TODAY (April 3, 2026), with all Petitioner's property returned to her upon release from custody. Petitioner shall be subject to the same conditions of release as were in place prior to her detention earlier this week. Petitioner shall not be redetained without 72 hours' notice of redetention provided to counsel. So Ordered by District Judge Melissa R. DuBose on 4/3/2026. (Urizandi, Nissheneyra)
