ENDORSED ORDER: The court has reviewed the petition and the record presented to date. The materials indicate that, on August 14, 2025, an Immigration Judge granted the petitioner release on bond in the amount of $7,500. That order was subsequently vacated by the BIA under Matter of Yajure Hurtado, 29 I&N Dec. 216 (BIA 2025). Approximately six months later, a different IJ denied bond, citing flight risk, based on what appears to be the same underlying factual record. Accordingly, the respondents are directed to show cause in writing on or before April 10, 2026 as to why the court should not conclude that the petitioner's continued detention violates the Due Process Clause of the Fifth Amendment, where two IJs, applying materially identical facts, reached inconsistent determinations as to the petitioner's eligibility for release. The respondents submission shall address, at a minimum, (1) whether any material factual developments occurred between the two bond determinations; (2) the legal basis for the second IJs departure from the first IJs findings; and (3) whether the procedures employed satisfy due process under these circumstances. See generally Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021). The respondents' submission shall also include the audio recording of the court-ordered bond hearing. So Ordered by Judge Joseph N.
