Morrison: The Court convened a hearing and oral argument on 23 the Amended Petition for a Writ of Habeas Corpus on September 29, 2025 at 11:30 AM. Cassandra Charles, Kevin Siegel, and Marlene Nathalie Berroa Rodriguez from the National Immigration Law Center appeared on behalf of Petitioner Jhon Peter Hyppolite, who also appeared. Assistant United States Attorney Richard K. Hayes appeared on behalf of Respondents. After argument, the Court issued an oral ruling granting 23 the application for a writ of habeas corpus, ordering Respondents to immediately release Petitioner from custody, and further ordering that Petitioner not be re-detained without notice and an opportunity to be heard at a pre-deprivation bond hearing before a neutral magistrate, at which the government will bear the burden of showing that his detention is authorized pursuant to 8 U.S.C § 1226(a). The Court entered a short written order regarding the above, filed by the Court at ECF No. 26, and informed the parties that it may follow its oral ruling with a written memorandum opinion. As discussed on the record, if either party wishes to file a motion for reconsideration of any portion of the Court's ruling, it shall do so no later than October 16, 2025. MEMORANDUM AND OPINION: As stated on the record on September 29, 2025, Hyppolite's 23 Amended Petition for a writ of habeas corpus under 28 U.S.C. § 2241 is GRANTED. The attached order memorializes and sets forth the grounds for the Cour t's ruling in greater detail.At the hearing on September 29, 2025, the Court ordered Respondents to immediately release Hyppolite from custody, and was later informed by Respondents' counsel that he was released that same day. The Court further orders that Hyppolite shall not be re-detained without notice and an opportunity to be heard at a pre-deprivation bond hearing before a neutral decisionmaker, where the government will have the burden of showing that his detention is authorized under 8 U.S.C. § 1226(a).Ordered by Judge Nina R.
