MINUTE ORDER (Text Only Entry) The Court has reviewed the papers filed thus far in this matter, including the request for a temporary restraining order. (Doc. 1 .) On this limited, ex parte record, the Court preliminarily believes Petitioner has at least raised serious questions going to his First Amendment Retaliation claim and demonstrated that some form of injunctive relief regarding his custody status may be appropriate, assuming custody continues. See generally Am. Ass'n of Univ. Professors v. Rubio, No. CV 25-10685-WGY, --- F. Supp. 3d ---, 2025 WL 2777659 (D. Mass. Sept. 30, 2025); Aditya W. H. v. Trump, 782 F. Supp. 3d 691, 712 (D. Minn. 2025). Thus, pursuant to 28 U.S.C. § 2243, Respondents are ordered to show cause in writing no later than noon on November 3, 2025 why the Court should not grant Petitioner's motion for a temporary restraining order. Petitioner may file a reply no later than noon on November 5, 2025. The Parties are further ordered to appear for a hearing on the motion before the undersigned at 9:00 am on Wednesday, November 12, 2025 via Zoom videoconference (details to be provided to the parties prior to the hearing). The Court would be amenable to a less accelerated briefing/hearing schedule, assuming the parties can reach a stipulation to that effect.In addition, because it appears that Respondent's own regulations and policies require that Petitioner be afforded access to counsel and notice before a venue change, and given the sworn assertions by counsel that they have had limited opportunities to consult with Petitioner and that he has been warned of an unexplained relocation, to maintain the status quo, the Court ORDERS the following: absent Petitioner's consent (after an opportunity to consult with counsel) or a further order of the Court, Respondents shall not transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). No later than TODAY, October 28, 2025, to the extent not already accomplished, Petitioner's counsel is directed: (1) to serve respondents with a copy of the Petition, the motion for temporary restraining order, and accompanying papers, along with a copy of this Order, by e-mail to all appropriate recipients including the United States Attorney's Office for the Eastern District of California and by overnight mail; and (2) promptly file proof of such service on the docket.
