ENDORSED ORDER. The Government has responded to the underlying habeas petition. But its response fails to address several of the arguments raised. Petitioner is not challenging the immigration judge's denial of his bond request. Rather, he is raising several constitutional challenges to the bond hearing process itself. The Government is directed to file a supplemental brief, on or before, April 30, 2026 that confronts the claims raised. To ensure clarity, the Government must address: Petitioner's claim that his arrest was unlawful; Petitioner's claim that the burden of proof before the immigration judge violates due process; and Petitioner's claim that the immigration judge is not an impartial tribunal contrary to due process. ORDER granting in part 33 Petition for Writ of Habeas Corpus filed by Jorge Facio Orozco. Within ten days of this order, the Government shall either bring Orozco for an individualized bond hearing before an immigration judge or release him under reasonable conditions of supervision. To satisfy this order, the hearing must include--and the resulting order must reflect--consideration of evidence properly submitted by the petitioner and the factors announced in In re Guerra, 24 I. & N. De c. 37 (BIA 2006), and the Government must bear the burden of proof to justify continued detention. Laborde Casallas v. Ripa, No. 2:26-CV-02137-SPC-KRH, 2026 WL 2162793, at *2 (M.D. Fla.
