District Judge Angel Kelley: ELECTRONIC ORDER entered. In this action, Petitioner Carla Lorena Teotonio-Aguiar challenges her detention by the Department of Homeland Security. Petitioner is currently incarcerated at the South Texas Family Residential Center in Dilley, Texas.As the Supreme Court has noted, under 28 U.S.C. § 2241, “District Courts are limited to granting habeas relief in their respective jurisdictions.” Rumsfeld v. Padilla, 542 U.S. 426, 442 (2004) (quoting 28 U.S.C. § 2241(a)). A petitioner must file a habeas petition in the district in which they are confined and name as a respondent the petitioner’s immediate custodian. Id. at 442-47. There are limited exceptions, including where the petitioner’s location is unknown at the time of filing or where there is evidence of “furtiveness” or bad faith by the government in conducting the transfer. SeeVan Tran v. Hyde, No. 25-CV-12546, 2025 WL 3171210 (D. Mass. Nov. 13, 2025); Ozturk v. Trump, 777 F. Supp. 3d 26 (D. Mass. 2025). Here, Petitioner challenges her present physical confinement at a facility located within the Western District of Texas. Because Petitioner was not in custody within the District of Massachusetts at the time the Petition was filed, and because no facts are alleged supporting an exception to the district-of-confinement rule, this Court is without jurisdiction to adjudicate this matter. When a district court lacks jurisdiction, as is the case here, it may, in the interest of justice, order the case to be transferred to another court that would have jurisdiction. 28 U.S.C. § 1631. Here, the Court finds that it is in the interest of justice to transfer the action to the appropriate district.Accordingly, the Court hereby ORDERS the matter transferred to the U.S. District Court for the Western District of Texas.(CEH) [Transferred from Massachusetts on 3/31/2026.] (Entered: 03/31/2026)
