ELECTRONIC ORDER. Before the Court is Petitioner's Motion for Release Pending Adjudication of Habeas Petition. Doc. 13, [13-1]. In the alternative, Petitioner asks the Court to adjudicate her habeas petition in an expedited manner. Doc. 13-1 at 6. Petitioner has not met her burden to show that she is entitled to release pending a ruling on her habeas petition. She has not shown that she is raising "substantial constitutional claims upon which [s]he has a high probability of success," and that "extraordinary or exceptional circumstances exist which make the grant of bail necessary to make the habeas remedy effective." Calley v. Callaway, 496 F.2d 701, 702 (5th Cir. 1974) (per curiam). See also United States v. Poff, No. 22-20212, 2022 WL 3335781, at *1 (5th Cir. Aug. 12, 2022) (applying Calley standard in affirming denial of bail pending determination of a 28 U.S.C. § 2255 case); United States v. Bazemore, 395 F. App'x 145, 146 (5th Cir. 2010) (same as to denial of a motion for release pending appeal). Additionally, Petitioner cannot meet her burden to show good cause to expedite a ruling. "There is no statutory or constitutional right to the disposition of a [habeas petition] within a specific time." United States v. Samples, 897 F.2d 193, 194 (5th Cir. 1990). Further, a federal district court has inherent power to control its docket and determine the order in which to hear and decide pending cases. See United States v. Colomb, 419 F.3d 292, 299 (5th Cir. 2005). Although 28 U.S.C. § 1657 requires federal courts to expedite matters if good cause is shown, that requirement is "relative, not specific." Samples, 897 F.3d at 195; see also 28 U.S.C. § 1657(a). Therefore, Petitioner's motion for release or an expedited ruling is DENIED. ELECTRONIC ORDER: The Clerk of the Court is directed to change the caption to reflect that the Warden of the Prairieland Detention Center is the only proper respondent in this habeas corpus action under 28 U.S.C. § 2241. See Rumsfeld v. Padilla, 542 U.S. 426, 434-35 (2004) (explaining that there is generally only one proper respondent in a habeas case, and that is the person who holds the petitioner in custody). All other named respondents are terminated from this civil action. However, Petitioner may object to this modification within 14 days of the date of entry of this order.
