MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 5/1/2026. On March 30, 2026, petitioner Lenin Canales Velasquez filed a threadbare petition for a writ of habeas corpus seeking his release from immigration custody. 1 I appointed the FPD as counsel for petitioner and directed counsel to file an amended petition, if one was warranted, and stayed the respondents' obligation to respond until further order. 3 Petitioner has now filed a counseled amended petition, and I find that it states a prima facie case for relief. 5 I thus direct the respondents to file a response to the amended petition on May 8, 2026. The respondents must file any documents referenced or relied upon in their responsive pleading with that pleading. The petitioner's reply is due May 15, 2026.Petitioner also moves to seal the exhibits attached to his amended petition because they "include his date of birth, social security number," and other confidential information. 7 That motion is GRANTED because compelling reasons exist to keep that personal identifying information private. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 5/11/2026.Earlier today, this case was transferred to the Honorable Judge Richard F. Boulware, II because it is related to Jacobo Ramirez v. Mullin, No. 2:25-cv-02136-RFB-MDC (D. Nev.). In other words, Petitioner may be eligible for relief pursuant to the Court's class-wide grant of partial summary judgment. See Jacobo Ramirez v. Mullin, No. 2:25-cv-02136-RFB-MDC, 2026 WL 879799, at *33-34 (D. Nev. Mar. 30, 2026).To preserve the Court's jurisdiction over this putative class claim, the Court temporarily enjoins Respondents from moving Petitioner beyond the United States District of Nevada. This Court has "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction." F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966); Al Otro Lado v. Wolf, 952 F.3d 999, 1007 n.6 (9th Cir. 2020) ("Having concluded that [agency action] would interfere with the courts jurisdiction..., the district court properly issued an injunction under the All Writs Act.") (citing 28 U.S.C. §1651(a)). Such an injunction is appropriate here. The Supreme Court of the United States has repeatedly held that only one district has jurisdiction over a "core habeas petition:" "the district of confinement." Trump v. J.G.G., 604 U.S. 670, 672 (2025) (citing Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004)). Were Petitioner removed from the District of Nevada, this Court could potentially lose jurisdiction over their claim(s). Therefore, IT IS HEREBY ORDERED Respondents are ENJOINED from moving Petitioner beyond the District of Nevada until this Court orders otherwise. IT IS FURTHER ORDERED Respondents may seek leave of Court if, and when, they intend to remove Petitioner from this judicial district. For the sake of clarity, IT IS FURTHER ORDERED this administrative stay supersedes the temporary injunction which was originally entered on March 31, 2026.
