MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 5/14/2026. Petitioner Juan Gomez Riazo sent his pro se petition for a writ of habeas corpus to the court on March 23, 2026, and it was docketed on March 30th. 1 On March 31st, I issued an order appointing him counsel and prohibiting the respondents from transferring him out of this district while his habeas petition is pending. 3 On May 7, 2026, petitioner's counsel filed a motion for an order directing the respondents to transfer the petitioner back to Nevada, representing that Riazo had been transferred to a facility in California. 11 Respondents filed a status report informing the court that Riazo was transferred on March 29, 2026--two days before the order prohibiting transfer was entered. They oppose his transfer back to this state due to bed-space concerns. 13 Because Riazo was transferred before the court prohibited that transfer, it does not appear that the respondents have violated a court order. And it appears that this court retains jurisdiction over Riazo's petition regardless of whether he has transferred after he filed his petition. See, e.g., Ex Parte Endo, 323 U.S. 283 (1944). So I order Riazo to SHOW CAUSE by May 18, 2026, (1) why his return to this district is within this court's authority to direct, (2) why his return is necessary to resolve this habeas proceeding, and (3) whether transfer to the district in which Riazo is currently confined would be permissible and in the interests of justice.
