TEXT ORDER: This matter comes before the Court upon Petitioner Luis A. Guevara Morales's Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241. D.E. 1 ("Petition"). Petitioner challenges his detention by immigration authorities as unlawful and seeks immediate release. In accordance with Rule 4 of the Rules Governing 2254 Cases, applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Petition for dismissal and determined dismissal without an answer is not warranted. Respondents shall file an expedited answer to the Petition within 7 days. In that Answer, Respondents shall inform the Court whether they stipulate that Petitioner has no criminal record. In addition, the Petition indicates that Petitioner is detained at Delaney Hall, which makes the Warden or Administrator of Delaney Hall his immediate custodian. See Rumsfeld v. Padilla, 542 U.S. 426, 435 (2004) ("[I]n habeas challenges to present physical confinement- 'core challenges'-the default rule is that the proper respondent is the warden of the facility where the prisoner is being held, not the Attorney General or some other remote supervisory official."). However, the Warden of Delaney Hall is not named as a Respondent. See Petition. To correct this deficiency, the Court directs Petitioner's counsel to file an amended habeas petition within 3 days that names Petitioner's immediate custodian as a Respondent.
