PAPERLESS ORDER. THIS MATTER is before the Court on the pro se "Motion to Establish Next Friend Standing" ("Motion") filed by Next Friend Yadira Garcia ("Next Friend") in this federal habeas corpus proceeding brought pursuant to 28 U.S.C. § 2241 on behalf of Petitioner Alexander Valladares Orta ("Petitioner"). In the Motion, Next Friend states that she is the Petitioner's niece and that she is "close" to Petitioner, maintaining "regular contact with him prior to his detention." (Id. at 1.) Next Friend explains that she is "acting solely in [Petitioner's] best interest" and wishes to pursue this action on Petitioner's behalf because he is unable to do so, as he "does not speak or understand English[,] lacks "meaningful access to legal documents[,]" and "has recently experienced serious health issues [that] has required hospitalization while in detention." (Id.) As such, she seeks an Order from the Court granting her next friend standing. (Id.) Given Next Friend's representations, the Court finds she has standing to bring this § 2241 action on behalf of Petitioner. See Whitmore v. Arkansas, 495 U.S. 149, 162 (1990). Accordingly, upon review of the Motion, pertinent portions of the record, and applicable law, it is ORDERED AND ADJUDGED that Next Friend's Motion (DE 9) is GRANTED. Signed by Judge Kathleen M.
