MINUTE ORDER signed by District Judge Dena M. Coggins on 4/1/2026: On 3/30/2026, a 1 habeas petition, 2 motion for a temporary restraining order, 3 motion to stay removal, 4 motion for immediate release, and 5 motion to expedite consideration, were filed on Petitioner's behalf by Yamileth Nohemy Vazquez Alvarado who is purporting to act under "next friend" status in a pro se capacity. However, "a next friend must provide an adequate explanation--such as inaccessibility, mental incompetence, or other disability--why the real party in interest cannot appear on his own behalf to prosecute the action," and "must be truly dedicated to the best interests of the person on whose behalf he seeks to litigate." Argueta-Guevara v. Johnson et al., No. 1:26-cv-02161-DAD-CSK, 2026 WL 785868, at *1 (E.D. Cal. Mar. 20, 2026) (quoting Whitmore v. Arkansas, 495 U.S. 149, 162 (1990)). No such showing has been made here. Further, a next friend cannot proceed pro se. Soza v. Warden of Cal. City Det. Facility, No. 1:26-cv-00737-KES-SAB (HC), 2026 WL 237716, at *1-2 (E.D. Cal. Jan. 29, 2026). Accordingly, Petitioner's pending 2 3 4 5 motions are all DENIED, without prejudice. This matter is referred to the assigned magistrate judge for further proceedings.
