TEXT ORDER. On March 30, 2026, pro se Petitioner filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241, alleging that he has been detained subject to a final order of removal for over six months. ECF No. 1. Because "there is no significant likelihood that [his] removal from the country will materialize within a reasonably foreseeable timeframe[,]..." Petitioner requests his immediate release from custody or release from custody within 30 days if he is not removed from the United States within that timeframe. id. The Court issued an Order to Show Cause, which, inter alia, enjoined Respondents from transferring Petitioner out of the United States until after the Court determined whether an evidentiary hearing was warranted. ECF No. 2. In a letter dated April 10, 2026, Respondents advised that Petitioner is scheduled on an ICE charter flight that will depart from the United States prior to April 24, 2026, and asked the Court to lift the stay of removal that was previously entered. Because there is a significant likelihood that Petitioner's removal will materialize within a reasonably foreseeable timeframe, the Court lifts the stay of removal in order to effectuate his departure, which is the relief sought by Petitioner.
