Judge Brian E. Murphy: ELECTRONIC ORDER entered. Petitioner is incorrect that he became “present in the United States” upon termination of his parole. Dkt. 8 at 2; see 8 U.S.C. s. 1182(d)(5)(A). Therefore, his detention is governed by 8 U.S.C. s. 1225, and he is entitled to a bond hearing. See Rincon v. Hyde, 810 F.Supp.3d 101, 116 (D. Mass. 2025). Accordingly, the Court GRANTS this Petition in part and ORDERS that Petitioner receive a constitutionally adequate bond hearing to consider the merits of his release. (MBM) (Entered: 04/03/2026)
