MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for District Judge Dale A. Drozd on 3/30/2026: Pending the issuance of the court's order resolving the pending 2 motion for temporary restraining order, and unless and until the court orders otherwise, the court ORDERS that respondent shall not take any action to remove petitioner from the United States or to move petitioner out of the Eastern District of California. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (acknowledging the court's express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction). Given the exigent circumstances present, the court finds that this order is warranted to maintain the status quo pending its forthcoming order resolving petitioner's pending 2 motion for temporary restraining order. In light of petitioner's pro se status, the Clerk of the Court is DIRECTED to serve respondent with a copy of the petition, motion for temporary restraining order, and accompanying papers, along with this order, to the United States Attorney's Office for the Eastern District of California by email at usacae.ecf2241-imm@usdoj.gov. Counsel for respondent shall promptly enter Notices of Appearance. Respondent shall file a written opposition to the pending 2 motion for temporary restraining order by 5:00 PM Wednesday, 4/1/2026. In that opposition, respondent shall substantively address whether any provision of law or fact in this case would distinguish it from the court's decision in P.A.H.E. v. Noem, No. 1:26-cv-01164-DJC-JDP, 2026 WL 451662 (E.D. Cal. Feb. 17, 2026), and other similar cases previously decided by this court, or otherwise indicate that the matter is not substantively distinguishable. Furthermore, respondent is DIRECTED to indicate in its opposition whether it opposes converting the motion for temporary restraining order into a motion for preliminary injunction and whether it opposes the court resolving the merits of the underlying habeas petition. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for District Judge Dale A. Drozd on 4/2/2026: On 3/30/2026, petitioner filed a motion for temporary restraining order. (Doc. No. 2 .) On the same day, the court issued an order directing respondent to indicate whether this case is distinguishable from that addressed in the court's order issued in P.A.H.E. v. Noem, No. 1:26-cv-01164-DJC-JDP, 2026 WL 451662 (E.D. Cal. Feb. 17, 2026), where the court concluded that detaining the petitioner who was originally released into the U.S. as an unaccompanied minor by the Office of Refugee Resettlement ("ORR") violated due process. (Doc. No. 4 .) On 4/1/2026, respondent filed an opposition to the pending motion. (Doc. No. 6 .) Therein respondent concedes that, aside from petitioner not being subject to 8 U.S.C. §1232(c)(2)(B) because he has not been transferred into the custody of the Department of Homeland Security ("DHS"), respondent does not have any legal or factual arguments to distinguish this case from P.A.H.E. (Id. at 2-3.) Respondent is also amenable to the court converting petitioner's motion for temporary restraining order into a motion for preliminary injunction. (Id. at 2.) It is undisputed that petitioner entered the United States as an unaccompanied minor and was released into the country to a family sponsor by the ORR. Petitioner contends that he has no prior criminal history and was arrested by Immigration and Customs Enforcement agents on 1/29/2026 at his place of employment. The court notes that the decision to release the petitioner in P.A.H.E. was not driven by 8 U.S.C. § 1232(c)(2)(B), nor was the petitioner purportedly subject to that statutory provision, so the court rejects respondents' attempt to distinguish P.A.H.E. in this regard. Having considered the circumstances surrounding petitioner's detention and the parties' arguments, the court adopts the reasoning set forth in P.A.H.E. and concludes that petitioner's detention violates due process. Accordingly, the court CONVERTS petitioner's motion for temporary restraining order into a motion for preliminary injunction and GRANTS it as follows: (1) respondents are ORDERED to immediately release petitioner from respondents custody; (2) respondents are ENJOINED and RESTRAINED from re-detaining petitioner for any purpose, absent exigent circumstances, without written notice and a hearing before an immigration judge where respondents will have the burden of establishing that petitioner is either a flight risk or danger to the community by clear and convincing evidence. Under the circumstances of the case, petitioner will not be required to post bond pursuant to Rule 65(c) of the Federal Rules of Civil Procedure. The Clerk is directed to serve the California City Corrections Center with a copy of this Order. The petition for writ of habeas corpus (Doc.
