ORDER - To further protect the status quo pending resolution of this case, unless otherwise ordered by this Court, Petitioner shall not be moved outside of the District of Oregon without first providing advance Notice of Intended Removal. Such Notice must be filed in writing and on the docket in this proceeding and must state the reason that Respondents believe such a move is necessary and should not be stayed pending further court proceedings. Once that Notice has been filed on the docket, the Petitioner shall not be moved out of the District for a period of at least 48 hours from the time of the docketing. If the 48-hour period would end on a weekend or legal holiday, the period continues to run until the same time on the next day that is not a weekend or legal holiday. Fed. R. Civ. P. 6(a)(2)(C). This period may be shortened or extended as appropriate by further Court order. If Respondents have already moved Petitioner outside of this District, Respondents are ordered to file a Notice of Prior Removal that states the exact date and time that Petitioner left the District of Oregon and the reason why Respondents believed that such a move was immediately necessary. Such Notice of Prior Removal will be due either: a. Within two hours of being served with this Order if the Order is filed from 8:00AM PST to 6:00 PM, PST, or b. By 9:00AM PST the following day if this Order is filed between 6:00 PM PST and 8:00 AM PST. ORDER granting in part Petitioner's 1 Petition for Writ of Habeas Corpus. The petition for a writ of habeas corpus, Dkt. No. 1 , is GRANTED IN PART and DENIED IN PART; and the motion for leave to file out-of-time reply, Dkt. No. 25 , is GR ANTED. The Court orders as follows: (1) Respondents must provide Mata Perez with a bond hearing under Section 1226(a) before an immigration judge within seven days of the date of this Order. At the hearing, Mata Perez will have the burden of prov ing by a preponderance of the evidence that he is not is a danger to the community or a flight risk. Respondents must ensure that the hearing is recorded. Respondents are enjoined from denying bond to Mata Perez on the basis that he is detained pursu ant to 8 U.S.C. § 1225(b). (2) If a bond hearing is not provided within seven days of the date of this Order, Mata Perez shall be released from ICE custody immediately on the terms of his most recent OREC or other terms consistent with Secti on 1226(a). Respondents must file a Status Report with the Court either confirming that Mata Perez received a bond hearing--and the results of that hearing--or otherwise confirming his release by June 10, 2026. (3) If the immigration judge does n ot order Mata Perez released, Respondents are prohibited from transferring Mata Perez from this jurisdiction--i.e., the Western District of Washington--for seven days following the immigration judge's decision, unless such transfer is necessary for medical evaluation, medical treatment, release, or extenuating circumstances;(4) Any fee petition should be filed within the deadlines set by the Equal Access to Justice Act, 28 U.S.C. § 2412.
