TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Henry Christofer Moran Dioses, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner, a citizen of Peru, was detained by U.S. Immigration and Customs Enforcement on December 9, 2025. He alleges that he entered the United States without inspection in 2022, and has continuously resided here since. Petitioner asserts that he is unlawfully detained pursuant to 8 U.S.C. § 1225(b), and that his continued detention violates the Due Process Clause of the Fifth Amendment. (Id.) Having reviewed the Petition and the record presently before it, the Court finds that immediate relief is warranted. Accordingly, it is hereby ORDERED that Petitioner shall be IMMEDIATELY RELEASED from Respondents' custody. It is further ORDERED that Petitioner shall be restored to the legal posture and status he occupied immediately prior to his detention on December 9, 2025. Respondents shall file proof of Petitioner's release on the docket within forty-eight (48) hours of the entry of this Order. A formal written opinion setting forth the Court's reasoning will follow. So Ordered by Judge Karen M. Williams on March 31, 2026. (Williams, Karen) (Entered: 03/31/2026)
