ENDORSED ORDER re 1 Petition for Writ of Habeas Corpus. Text of Order: The government does not dispute that the petitioner is entitled to a bond hearing as a matter of due process if the court applies Judge Elliott's reasoning in Destino v. FCI Berlin, Warden, Civ. No. 25-cv-374-SE-AJ, 2025 WL 4010424 (D.N.H. Dec. 24, 2025). The court finds Destino persuasive and applies it. The court notes that, because petitioner is entitled to a bond hearing as a constitutional matter, the possibility that his dismissed criminal charges might bring him within the ambit of 8 U.S.C. 1226(c) is irrelevant. See Destino, 2025 WL 4010424, at *3 ("The court assumes without deciding that Destino's detention is legally mandated by 1225(b)(1), but does not reach the respondents' statutory argument because it finds that Destino's detention without a bond hearing offends the Due Process Clause regardless of whether the INA authorizes it or mandates it."). The petition (doc. no. 1) is granted. Respondents are ordered to provide the petitioner with a constitutionally adequate bond hearing before an IJ within 7 days. On or before April 7, 2026, the government shall file a status report notifying the court of the result of the bond hearing. So Ordered by Judge Landya B. McCafferty.(vln)
