Respondent SHALL NOT deny Petitioner's bond on the basis that 8 U.S.C. § 1225(b)(2) requires mandatory detention. MINUTE ORDER Denying Without Prejudice Petitioner's 7 Emergency Motion to Enforce Judgment. On April 1, 2026, the Court ordered Respondents to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within fourteen days. Petitioner received a bond hearing and now seeks review of the immigration judge's denial of bond. Because Petitioner has failed to exhaust his administrative remedies by appealing to the BIA and has not raised any basis for waiving exhaustion, Petitioner's Motion is denied without prejudice. See Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011) (remanding with the instruction to dismiss the petition without prejudice because the petitioner had not exhausted his administrative remedies nor demonstrated grounds for excusing exhaustion).
