The Court has previously addressed the legal issues raised by the 3 motion for temporary restraining order. See e.g., Crispin M.C. v. Noem, No. 1:25-CV-01487-KES-HBK (HC), 2026 WL 70553 (E.D. Cal. Jan. 8, 2026); J.A.C.P. v. Wofford, No. 1:25-CV-01354-KES-SKO (HC), 2025 WL 3013328 (E.D. Cal. Oct. 27, 2025); Lepe v. Andrews, 801 F. Supp. 3d 1104 (E.D. Cal. 2025). On or before March 31, 2026, respondents are ORDERED TO SHOW CAUSE as to whether there are any factual or legal issues in this case that distinguish it from the Court's prior orders in Crispin M.C. v. Noem, J.A.C.P. v. Wofford and Lepe v. Andrews and justify denying the motion, or indicate the matter is not substantively distinguishable. Respondents shall state their position as to whether the 3 motion for temporary restraining order should be converted into a motion for preliminary injunction and whether they request a hearing on the 3 motion. Pending the Court's decision, and unless and until the Court orders otherwise, the Court ORDERS that respondents shall not transfer petitioner out of this District. See F.T.C. v. MINUTE ORDER signed by District Judge Kirk E. Sherriff on 4/01/2026: (Text Only Entry). The 3 motion for temporary restraining order is denied. Petitioner's motion fails to address the statute governing his detention. Petitioner's reliance on Pinchi v. Noem, 792 F.Supp.3d 1025, 1032 (N.D. Cal. 2025), which considered the re-detention of a noncitizen who was released from custody under 8 U.S.C. § 1226(a) and was subsequently re-detained pursuant to 8 U.S.C. § 1225(b)(2)(A), is misplaced because petitioner became subject to 8 U.S.C. § 1226(c)(1)(A) when he was convicted of violating California Penal Code § 115(a). Respondents' records show that, on September 4, 2025, petitioner was convicted of knowingly procuring or offering any false or forged instrument to be filed, registered, or recorded in a public office under California Penal Code § 115(a). See Doc. 8, Ex. 5 at 40. ICE arrested petitioner the same day he was convicted. See Doc. 8, Alvarado Decl. at 18; Doc. 8, Ex. 6. California Penal Code § 115(a) is a fraud crime, and "fraud crimes are categorically crimes involving moral turpitude, simply by virtue of their fraudulent nature." Planes v. Holder, 652 F.3d 991, 997 (9th Cir. 2011). 8 U.S.C. § 1226(c)(1)(A) mandates the detention of those who have committed a crime involving moral turpitude. See 8 U.S.C. § 1226(c)(1)(A); 8 U.S.C. § 1182(a)(2)(A)(i)(I). To the extent that detention under § 1226(c) may become unreasonably prolonged at some point, petitioner's motion does not meaningfully address that issue and he fails to establish a likelihood of success on any argument that his detention exceeds the time that the Supreme Court found to be constitutional in Demore v. Kim, 538 U.S. 510, 529 n.12 (2003). This matter is referred to the assigned magistrate judge for further proceedings on the petition. (Deputy Clerk VMG) (Entered: 04/01/2026)
