MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 4/9/2026.On March 27, 2026, this Court enjoined Respondents from transferring Petitioner beyond the United States District of Nevada. See Order to Show Cause at 3, Dkt. No. 5 (citing 28 U.S.C. § 1651) ("Respondents shall not transfer Petitioner to a detention center outside of this judicial district, pending further order of the Court."). Since then, Petitioner's Counsel has advised the Court that "Petitioner has been transferred to California City Corrections Center," in spite of this Court's prior order. See Pet'r's Traverse at 2, Dkt. No. 9 . As such, the Court finds that it must adopt preliminary, remedial measures to ensure that Respondents are complying with its orders. See Cahill v. Insider Inc., 131 F.4th 933, 938 (9th Cir. 2025) (reaffirming that a district court has the inherent authority to "enforce its orders by whatever means" necessary) (citation omitted). Therefore, IT IS HEREBY ORDERED Respondents must file a status report which confirms Petitioner's current location by 5:00 P.M. on April 10, 2026. If Petitioner has been transferred beyond this judicial district, the status report must also explain: (i.) why Petitioner was transferred and (ii.) why this Court should not order Respondents to immediately return Petitioner to the United States District of Nevada. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 5/5/2026.On April 29, 2026, the Court awarded Petitioner a writ of habeas corpus. See generally Order Granting Writ of Habeas Corpus, ECF No. 15 [hereinafter, "Order Granting Writ"]. Specifically, the Court ordered Respondents to: (a.) release Petitioner or (b.) supply him with a constitutionally adequate bond hearing by May 1, 2026. See id. at 8. In spite of this Court's explicit instructions, Petitioner remains in custody, and a bond hearing has yet to occur. See Pet'r's Status Report 2, ECF No. 17 . Respondents have presented no explanation for their failure to follow this Court's Order. On this record, the Court finds that it must adopt remedial measures to enforce its own orders. See Cahill v. Insider Inc., 131 F.4th 933, 938 (9th Cir. 2025) (reaffirming that district courts have "the inherent authority... to enforce [their own] orders by whatever means" necessary) (citation omitted).For the foregoing reasons, IT IS HEREBY ORDERED Respondents must IMMEDIATELY RELEASE Petitioner from custody TODAY (May 5, 2026) by no later than 7:00 P.M. In doing so, Respondents must comply with all of the directives outlined in this Court's prior order. See Order Granting Writ at 8-10. Thus, amongst other things, Petitioner must be released on his own recognizance, i.e., without conditions that substantially interfere with Petitioner's liberty.
