Order Appointing Counsel and Deferring Consideration of 28 U.S.C. § 2241 Petition IT IS THEREFORE ORDERED that the motion for leave to proceed IFP [ECF No. 1 ] is GRANTED. IT IS FURTHER ORDERED that the motion for appointment of counsel [ECF No. 1 -2] is GRANTED. The Federal Public Defender for the District of Nevada (FPD) is appointed to represent the petitioner and is directed to file a notice of appearance (or indicate its inability to represent the petitioner) within 7 days of the date of this order. If the FPD is unable to represent the petitioner, alternate counsel will be appointed. Appointed counsel will represent the petitioner in all federal proceedings related to this matter, including any appeals or certiorari proceedings, unless allowed to withdraw. If the FPD files a notice of appearance in this matter, the FPD must, within 30 days from the date of this order, file either (1) an amended petition or (2) a motion to dismiss the petition. The FPD must effectuate service of the amended petition, if one is filed, on the respondents. IT IS FURTHER ORDERED that the Clerk of the Court is directed to: See order for additional information. IT IS FURTHER ORDERED that the respondents must not transfer the petitioner out of this district, with the exception of effectuating his lawful deportation. On March 26, 2025, Petitioner Santos Perez Ramirez filed a threadbare petition for a writ of habeas corpus seeking his release from immigration custody. 1 I appointed the FPD as counsel for petition and directed counsel to file an amended petition, if one was warranted, and stayed the respondents' obligation to respond until further order. 3 Petitioner has now filed a counseled amended petition, and I find that it states a prima facie case for relief. 9 So I direct the respondents to file a response to the amended petition by May 15, 2026. MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 6/17/2026. The respondents move to dismiss petitioner Santos Perez Ramirez's amended habeas petition on exhaustion grounds. 16 I have determined that the exhaustion question would be better considered in conjunction with the briefing on the merits of the petition. So the respondents' motion is DENIED without prejudice to raising those arguments again as part of a substantive response to the petition.The respondents must file a substantive response containing all of the arguments they seek to raise in this case by June 24, 2026. The respondents must attach any documents referenced or relied upon in their responsive pleading with that pleading, and they must specifically attach petitioner's (1) I-200 warrant for arrest of alien; (2) form I-286 initial custody determination; (3) form I-862 notice to appear; and (4) any further documents that might shed light on the detention authority under which the petitioner is currently detained.
