TEXT ONLY ENTRY by Judge Andre Birotte Jr. On Thursday, March 26, 2026, Petitioner Heliodoro Sanchez Perez (Petitioner) filed a Petition for Writ of Habeas Corpus (Petition, Dkt. No. 1 ). Also on Thursday March 26, at 2:24 p.m., Petitioner filed an Ex Parte Application for Temporary Restraining Order (TRO Application, Dkt. No. 3 ). Counsel states that he "made the following efforts to give notice to the U.S. Attorney's Office by servicing all of the submitted complaints and filings relevant to the case via mail to the corresponding U.S. Attorneys Office." See TRO Appl. p. 9. This statement does not specify who counsel attempted to give notice to, or where. In any event, it does not appear that counsel complied with Local Rule 7-19.2, which requires counsel "(a) to make reasonable, good faith efforts orally to advise counsel for all other parties, if known, of the date and substance of the proposed ex parte application and (b) to advise the Court in writing and under oath of efforts to contact other counsel and whether any other counsel, after such advice, opposes the application." Nor does the TRO Application include a proposed Order as required by Local Rules 7-20 and 52-4.1. However, pursuant to Appendix C to the Local Civil Rules, Agreement on Acceptance of Service, at case opening, the Petition and Application were sent to the Notice Only email account designated by the U.S. Attorneys Office. This Courts standing orders provide that responses to ex parte and TRO applications must be filed within 48 hours after service. The Court ORDERS that Respondents must respond to the TRO Application by Monday March 30, 2026, at 4:00 p.m. Petitioner is ORDERED to file a Proposed Order specifying the relief he seeks as soon as possible, but no later than Saturday March 28, 2026, a 12 noon.
