ENDORSED ORDER denying Respondent Warden of South Florida Detention Center's Motion to Dismiss Petition for Writ of Habeas Corpus (Doc. 7). "The federal habeas statute straightforwardly provides that the proper respondent to a habeas petition is the person who has custody over the petitioner." Rumsfeld v. Padilla, 542 U.S. 426, 434 (2004) (cleaned up). While courts have recognized that immigration detainees in state-run facilities can bring habeas claims against certain federal officials, see, e.g., Masingene v. Martin, 424 F. Supp. 3d 1298, 1301 (S.D. Fla. 2020), the immediate custodian is also a proper respondent. As the immediate custodian of the petitioner, the Warden is a proper respondent to his habeas petition. ENDORSED ORDER. Immigration detainee Yoandris L. Rosales Fuentes constructively filed his initial pro se petition for a writ of habeas corpus (Doc. 1) on 3/20/2026. But it was written in Spanish, and federal proceedings must be conducted in English. See United States v. Rivera-Rosario, 300 F.3d 1, 5-6 (1st Cir. 2002). The Court received an amended petition written in English on 6/5/2026, but by then Rosales Fuentes had another pending habeas action raising the same claims--Rosales Fuentes v. Florida Soft Side South, M.D. Fla. Case No. 2:26-cv-1558-KCD-KRH. Because this action is duplicative of 26-cv-1558, it is DISMISSED without prejudice. I.A. Durbin, Inc. v. Jefferson Nat. Bank, 793 F.3d 1541, 1552 (11th Cir. 1986) (explaining why federal courts should dismiss duplicative actions).
