Before the Court are Petitioner Mark Asharf Maher Haneen’s petition for writ of habeas corpus, [ECF No. 1 ], and motion for a temporary restraining order, [ECF No. 3 ]. “Respondents submit that the legal issues presented in this Petition are similar to those recently addressed by this Court in De Andrade v. Moniz,” [ECF No. 11 at 1]. In that case, another session of this Court held that when a noncitizen is initially detained under 8 U.S.C. § 1225(b)(1) but subsequently paroled into the country pursuant to 8 U.S.C. § 1226(a), the lawfulness of his redetention is governed by § 1226. De Andrade, 802 F. Supp. 3d 325, 332 (D. Mass. 2025). Here, it is unclear from the Petition, [ECF No. 1 ], under what authority Petitioner was paroled, however, Respondents acknowledge that “[s]hould the Court follow its reasoning in De Andrade, it would reach the same result here,” [ECF No. 11 at 1], and the Court, for present purposes, will rely on that representation. Accordingly, Petitioner is subject to 8 U.S.C. § 1226’s discretionary detention framework and, accordingly, entitled to a bond hearing. He has not received such a hearing, so his detention is unlawful.Petitioner’s petition, [ECF No. 1 ], is GRANTED IN PART. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 days of this order. Respondents are ENJOINED from denying Petitioner bond on the basis that he is detained pursuant to 8 U.S.C. § 1225(b). Respondents are ORDERED to file a status report within 14 days of this order stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reasons for that denial.Petitioner’s motion for a temporary restraining order enjoining Respondents from transferring him outside of the District of Massachusetts during the pendency of this action is DENIED AS MOOT. The Court has stayed the transfer of the Petitioner from the District of Massachusetts pending further order of the Court. [ECF No. 6 ].(CAM) (Entered: 03/30/2026)
