Judge Brian E. Murphy: ELECTRONIC ORDER entered. “Respondents acknowledge that, should the Court follow its reasoning in [Rincon v. Hyde, 2025 WL 3122784 (D. Mass. Nov. 7, 2025) and Tenemasa-Lema v. Hyde, 2025 WL 328055 (D. Mass. Nov. 25, 2025)], the Court would likely find that that ICE detention authority remains 8 U.S.C. § 1225(b)(1), but that, in this instance, Petitioner’s detention without a bond hearing violates his due process rights.” Dkt. 7 at 2. Accordingly, for the reasons stated in Rincon, the Court GRANTS this Petition in part and ORDERS that Petitioner receive a constitutionally adequate bond hearing to consider the merits of his release.
