Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Petitioner’s habeas petition asks this Court to order the government to provide him with a bond hearing under 8 U.S.C. § 1226(a). [ECF No. 1 at 15 - 16]. The government concedes that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) and that he thus is eligible for a bond hearing, [ECF No. 7 at 4], but states that, “there is no evidence available that indicates Petitioner... has filed a request for a bond hearing,” [id. at 5 n.2]. Petitioner is required to exhaust administrative remedies before seeking habeas relief. See, e.g., Quinonez Mercado ex rel. Abarca-Jovel v. Dep't of Homeland Sec., No. 1:25-CV-12066, 2025 WL 2430423, at *3 (D. Mass. Aug. 22, 2025) (denying habeas petition where there was no evidence that petitioner had requested bond hearing). Accordingly, Petitioner’s petition is dismissed without prejudice.(CAM) (Entered: 04/01/2026)
