(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner's ex parte application for a temporary restraining order (TRO) fails to comply with the notice requirements in Fed. R. Civ. P. 65, L.R. 65-1, L.R. 7-19.1 or to demonstrate "specific facts" exist warranting the issuance of a TRO without notice. Fed. R. Civ. P. 65(b)(1)(A). Petitioner shall promptly serve the TRO application on Respondents and file proof of service demonstrating compliance with all applicable rules and orders no later than March 27, 2026. Failure to file proof of service will result in summary denial of the application. The Court orders Respondents to file a notice of appearance by March 30, 2026 and SETS the following briefing schedule for the TRO application and underlying habeas petition: Respondents shall respond to both by April 1; and Petitioner shall file any replies by April 6. The Court encourages the parties to consider consenting to the jurisdiction of the assigned Magistrate Judge, which will expedite determination of the petition by avoiding the delay associated with the preparation and review of a Report and Recommendation. By April 1, the parties shall file a joint statement, signed by counsel for each party, stating whether they consent to proceed before the assigned Magistrate Judge for all purposes. Declining consent will not result in any adverse substantive consequences. Respondents shall provide Petitioner and Petitioner's counsel in this habeas action at least 48 hours' notice prior to any action to move or transfer any Petitioner from this district or to remove them from the United States.
