ORDER and FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Sean C. Riordan on 9/21/2026 DENYING 3 Motion to Appoint Counsel as moot and GRANTING 16 Motion to Proceed IFP. It is HEREBY RECOMMENDED that 1 Petition for Writ of Habeas Corp us be granted as follows: Respondents shall immediately release Petitioner Dongshun Zhang 221-468-470 from custody. At the time of release, Respondents must return all of Petitioner's documents and possessions. Upon Petitioner's release, R espondents shall enroll Petitioner in ICE's Intensive Supervision Appearance Program (ISAP) and impose GPS location monitoring and periodic home check-ins. Respondents may re-detain Petitioner if (1) Petitioner violates the conditions of release and Respondents provide Petitioner notice and an opportunity to be heard as to the alleged violation or (2) Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal. It is FURTH ER RECOMMENDED that 9 Motion to Dismiss be denied, that Petitioner's 11 Motion for Preliminary Injunction and 12 Renewed Motion for TRO be denied as moot, and that the Clerk of the Court be directed to serve California City Immigration Pro cessing Center a copy of the Order and enter Judgment and close case.
