Calabretta on 4/30/2026: Petitioner filed a Petition for Writ of Habeas Corpus (ECF No. 1 ), Motion for Temporary Restraining Order (ECF No. 2 ) and Supplemental Brief (ECF No. 9 ) arguing that the bond hearing Petitioner received as a result of this Court's previous order (No. 1:26-cv-1508-DJC-SCR) was constitutionally inadequate. The matter was fully briefed (Opp'n (ECF No. 10 ); Reply (ECF No. 12 ); Sur Reply (ECF No. 14 )). Respondents concede that there were issues with the notice Petitioner received about his bond hearing and do not object to another bond hearing. (Sur Reply at 1-2.)Accordingly, Petitioner's Petition is GRANTED (ECF No. 1 ) as to Count 1. Respondents are ORDERED to provide Petitioner with a bond hearing before a neutral arbiter pursuant to section 1226(a) and its implementing regulations, at which Petitioner's eligibility for bond must be considered. Respondents must provide the new hearing within fourteen (14) days of this Order and must provide Petitioner and Petitioner's Counsel with at least 48 hours' notice of the date, time, and place of the hearing. Respondents shall file a status report within five (5) days of Petitioner's bond hearing, confirming a bond hearing was conducted. If the parties are unable to provide Petitioner with a bond hearing within fourteen (14) days in accordance with this Order, they may jointly request a modification of the schedule.
