PAPERLESS TEMPORARY RESTRAINING ORDER: At 4:32 p.m., Petitioner requested an emergency temporary restraining order to prevent his removal from the United States pending briefing on the motion for preliminary injunction (ECF No. 10). That motion is GRANTED IN PART and RESERVED IN PART. To the extent Petitioner has requested a temporary restraining order, the motion is GRANTED; to the extent he has requested a preliminary injunction, the motion is RESERVED pending briefing. Petitioner has shown a likelihood of success on his claim (1) that pursuant to 8 C.F.R. § 208.31(b)-(c) and 8 C.F.R. § 1208.31(g), he has a right to review of his expression of fear of removal to Ghana by an asylum officer and, if he receives a negative determination, by an immigration judge before any removal would be permitted, and (2) that disregarding these regulations would deprive Petitioner of his opportunity to be heard before he is removed to a third country and would violate his rights under the Constitution. He has also shown that removal would result in irreparable harm to him. See A.A.R.P. v. Trump, 145 S. Ct. 1364, 1369 (2025). And the balance of the equities and public interest favor Petitioner. Accordingly, EFFECTIVE IMMEDIATELY it is hereby ORDERED that (1) Respondents and all of their officers, agents, servants, employees, attorneys, successors, assigns, and persons acting in concert or participation with them are hereby RESTRAINED from removing Petitioner from the United States; (2) a violation of this Temporary Restraining Order shall subject Respondents and all other persons bound by this Order to all applicable penalties, including contempt of court; and (3) Respondents are directed to ensure that the custodian of Petitioner is served with this Order immediately. Pursuant to Federal Rule of Civil Procedure 65(c), the Court finds that no bond is necessary. This TEMPORARY RESTRAINING ORDER remains in effect until Wednesday, October 29th at 5:00 p.m. ET. The Court will hold a Zoom hearing regarding whether Petitioners removal should be precluded pending the briefing of the motion for preliminary injunction on Wednesday, October 29th at 2:00 p.m. ET.
