MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 5/21/2026.The Court is in receipt of the parties' 19 and 20 Status Reports and Petitioner's 21 Motion to Enforce and finds that Federal Respondents are in violation of this Court's explicit Orders, and that their violations have caused ongoing harm to Petitioner.Therefore, IT IS HEREBY ORDERED that Federal Respondents must SHOW CAUSE in writing why they should not be held in contempt for (1) failing to provide advanced notice of the date, time, and location of Petitioner's release from detention and (2) failing to return Petitioner's work authorization and social security cards upon his release. See Order Granting Writ of Habeas Corpus at 15, ECF No. 16. Federal Respondents must further address the issue of the I-831 Form identified in Petitioner's 21 Motion to Enforce. Federal Respondents must detail each agency official involved in effectuating Petitioner's release and the timeline of events on the date of Petitioner's release. Federal Respondents' Show Cause Response is due by May 22, 2026. Petitioner may file a reply by May 25, 2026. IT IS FURTHER ORDERED that ICE must return Petitioner's work authorization and social security cards to counsel for Petitioner by no later than May 22, 2026. Counsel for Petitioner is instructed to ensure the safe delivery of these documents to Petitioner.IT IS FURTHER ORDERED that a hearing is set for May 26, 2026 at 11:30 AM. The agency officials involved in effectuating Petitioner's release from detention and retaining Petitioner's employment authorization and social security cards, including but not limited to Deportation Officer K Medina, see ECF No. 21-1, must appear at the hearing for examination under oath.Show Cause Response is due by 5/22/2026. Eaker; Time of Hearing: 2:31 - 3:08; 3:32 - 4:06; Courtroom: 7C; The Court makes preliminary remarks and hears from Federal Respondents as to Petitioners being released from custody at late hours on Las Vegas Boulevard or other inappropriate areas, without familial notification or notification to counsel as ordered, and without their personal property as ordered, as evidenced by Sira v. Mattos et al 2:26-cv-828-RFB-DJA and Reyes Campos v. Bondi et al 26-cv-850-RFB-BNW. A brief recess was taken in order for counsel to meet and confer regarding a procedure to ensure the safe and compliant release of petitioners. The Court approved the parties proposed timeline for release timing as outlined on the record. Counsel shall verify the proposed procedure with the detention facilities and Federal Respondents and shall email the Courtroom Administrator with the finalized procedure once verified. The proposal will be shared with the other District Court Judges once verified. Parties are to brief the issue regarding whether and how Class Members must request custody redetermination hearings, as outlined by the Court, by 5/28/2026. The Current deadlines and settings on the Orders to Show Cause in Sira v. Mattos et al 2:26-cv-828-RFB-DJA and Reyes Campos v. Bondi et al 26-cv-850-RFB-BNW are CONTINUED. The response deadline is extended until 5/27/2026. The reply deadline is extended until 5/29/2026.
