MINUTE ORDER (Text Only Entry) The Court has reviewed the papers filed thus far in this matter, including the request for a temporary restraining order. (Doc. 9 .) On this record, the Court preliminarily believes Petitioner is likely to demonstrate success on the due process claim and that injunctive relief may be appropriate. Thus, pursuant to 28 U.S.C. § 2243, Respondents are ordered to show cause in writing no later than noon on October 28, 2025 why the Court should not grant Petitioner's motion for a temporary restraining order. Petitioner may file a reply no later than noon on October 30, 2025. The Parties are further ordered to appear for a hearing on the motion before the undersigned at 1:30 pm on Tuesday, November 4, 2025 via Zoom videoconference (details to be provided to the parties prior to the hearing). >In the meantime, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the exigent circumstances, the Court finds that this order is warranted to maintain the status quo pending the hearing and any subsequent order and finds that Petitioner has satisfied the factors governing the issuance of such preliminary relief.No later than TODAY, October 24, 2025, to the extent not already accomplished, Petitioner's counsel is directed: (1) to serve respondents with a copy of the Petition, the motion for temporary restraining order, and accompanying papers, along with a copy of this Order, by e-mail to all appropriate recipients including the United States Attorney's Office for the Eastern District of California and by overnight mail; and (2) promptly file proof of such service on the docket. CORRECTED MINUTE ORDER signed by Magistrate Judge Erica P. Grosjean on November 3, 2025: On October 30, 2025, this case was reassigned to Magistrate Judge Grosjean for all purposes. (ECF No. 19 .) Also, on October 30, 2025, Petitioner filed a reply brief in support of the motion for temporary restraining order and an accompanying Declaration (ECF No. 20 -1) describing, among other things, statements made by Supervisory Detention and Deportation Officer Gilbert on October 29, 2025 representing that "the judge has not approved anything and [Petitioner] could still be deported at anytime. He said there is a hearing on November 4, 2025 but there has not been a ruling from the judge yet. He said he would be back again on November 5 to deport [Petitioner]." (ECF No. 20 -1 at 4.) The Court reiterates the District Judge's Order of October 24, 2025 (ECF No. 12 ), which is still in effect, that unless and until the Court orders otherwise, Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District.
