ORDER On March 31, 2026, Respondents filed an unopposed motion to partially lift the Court's March 21, 2026 no-transfer order (ECF No. 3), which the Court extended in the Court's March 24, 2026 order to show cause (ECF No. 9). Respondents request, and Petitioner does not oppose, the Court amend its no-transfer order to allow them to move Petitioner from his current detention site at CBP's Fort Fairfield Station facility to a long-term ERO facility in Massachusetts, New Hampshire, or Rhode Island. Respondents attest that the ERO facilities are equipped to handle longer-term detention of individuals pending a hearing before an Immigration Judge. Based on those representations, the Petitioner's acquiescence, and Respondents' confirmation that Petitioner will not be moved outside of one of these states without further order of this Court and that transferring Petitioner will not disturb the Court's continuing jurisdiction over this matter, the Court GRANTS Respondents' unopposed motion to partially lift the no-transfer order (ECF No. 11). The Court therefore ORDERS Respondents not to remove Kayo Garcia De Melo from the jurisdiction of the United States or transfer him to a judicial district outside that of Maine, Massachusetts, New Hampshire, or Rhode Island. If it is necessary for Mr. Garcia De Melo to attend a bond hearing before an Immigration Judge while in Respondents' custody, Respondents must bring him before an Immigration Judge sitting inside one these four authorized judicial districts. Respondents may not transfer Mr. Garcia De Melo outside these four judicial districts. Lastly, the Court ORDERS Respondents to provide Mr. Garcia De Melo reasonable access to counsel during his period of detention re 11 Motion to Partially Lift the No-Transfer Order By JUDGE JOHN A.
