TEXT ORDER: At the hearing on the petition held on 4/6/2026, the Court heard argument concerning the alleged violation of Petitioners Fifth Amendment due process rights by requiring Petitioner to bear the burden of proof at his initial bond hearing. As the parties agreed, Petitioner did not specifically raise this issue in his original papers, but more squarely addressed them in his reply. Accordingly, Respondents may, by Friday May 8, 2026 at 5 p.m., file a surreply with the Court responding to the argument that Petitioner is entitled to a new bond hearing at which the government bears the burden of proving, by clear and convincing evidence, that Petitioner poses either risk of flight or danger to community.
