Order Appointing Counsel and Deferring Consideration of 28 U.S.C. § 2241 Petition IT IS THEREFORE ORDERED that the motion for leave to proceed IFP [ECF No. 1 -2] is GRANTED. IT IS FURTHER ORDERED that the motion for appointment of counsel [ECF No. 1 -3] is GRANTED. The Federal Public Defender for the District of Nevada (FPD) is appointed to represent the petitioner and is directed to file a notice of appearance (or indicate its inability to represent the petitioner) within 7 days of the date of this order. If the FPD is unable to represent the petitioner, alternate counsel will be appointed. Appointed counsel will represent the petitioner in all federal proceedings related to this matter, including any appeals or certiorari proceedings, unless allowed to withdraw. If the FPD files a notice of appearance in this matter, the FPD must, within 30 days from the date of this order, file either (1) an amended petition or (2) a motion to dismiss the petition. The Court is in receipt of the parties' 21 and 22 Status Reports and Petitioner's 24 Motion to Enforce and finds that Federal Respondents are in violation of this Court's explicit Orders, and that their violations have caused ongoing harm to Petitioner.Therefore, IT IS HEREBY ORDERED Federal Respondents must SHOW CAUSE in writing why they should not be held in contempt for failing to provide advanced notice of the date, time, and location of Petitioner's release from detention. Eaker; Time of Hearing: 2:31 - 3:08; 3:32 - 4:06; Courtroom: 7C; The Court makes preliminary remarks and hears from Federal Respondents as to Petitioners being released from custody at late hours on Las Vegas Boulevard or other inappropriate areas, without familial notification or notification to counsel as ordered, and without their personal property as ordered, as evidenced by Sira v. MINUTES OF PROCEEDINGS - Show Cause Hearing held on 6/1/2026. Crtrm Administrator: D. Smith; Pla Counsel: Sylvia Irvin for Luis Sira; Def Counsel: Tamer Botros, Virginia Tomova and Summer Johnson; Ashlee Hesman for Warden Mattos; Christian Orme for Warden Rader; Cobi Burnett for Warden Balaam. ; Court Reporter: P. Eaker; Time of Hearing: 11:13 - 12:52; Courtroom: 7C; The Court hears from counsel as to the 25 26 Orders to Show Cause. Federal Respondents assert the 12-3 p.m. release window protocol will ensure compliance and appropriate notification to petitioners counsel in the future. The Court notifies Federal Respondents that, in the future, if ICE fails to release petitioners within that window, according to their proposed process, and fails to provide a satisfactory explanation for the violation, the Court will hold the agency officials responsible in contempt and issue appropriate sanctions. 11:30 a.m. Jose Collazo Deportation Officer, Las Vegas, NV, called forward and sworn, examined by the Court; Officer Collazo examined by Sylvia Irvin on behalf of Mr Sira. Based on the record and Officer Collazo's testimony, the Court finds Federal Respondents have failed to demonstrate any effort was taken to comply with this Courts orders requiring advanced notice of the timing of Petitioners release. Therefore, the contempt proceedings are continued, and Federal Respondents are ordered to supplement the record with sworn declaration(s) setting forth the following information, and supporting evidence, by June 8, 2026: 1. Based on a review of the video footage, the exact TIME that Petitioners Reyes Campos and Sira ARRIVED at the Federal Justice Tower, and the exact time Mr. Reyes Campos and Mr. Sira were RELEASED on May 15, 2026. The video footage be filed for the Court's and Petitioners' counsels review. The Court grants leave to file the footage under seal. 2. The date and time of any communications or efforts by Federal Respondents to inform AUSA Botros of the timing of Petitioners release; 3. The full names of the individual officers who were responsible for processing Petitioners' release on May 15, 2026. Those officers must file a declaration explaining why Petitioners' family and/or counsel were not notified of Petitioners' release. 4. With regards to Petitioner Sira, the individual officer(s) who processed Mr. Sira for release the night of May 15 must indicate in their declaration whether (1) a translator was used to communicate with Mr. Sira ; (2) when he was offered a phone call; (3) when he was given his cell phone, and whether or not it was charged when he was released. 5. The release paperwork for Mr. Sira must be filed for review by this Court. 6. The OPLA attorney(s) who distributed the Court's Orders to the ICE officers must be identified. 7. What provisions have been made to ensure advanced notice is provided in the future, when so ordered. The officers and agency officials with direct, personal knowledge of the above information are ORDERED to appear for examination at the next hearing, which is set for June 15, 2026 at 11:00 a.m. Supervisory Officers Cloyd Umali and Gabriel Ruiz are also ordered to appear. No substitute witnesses will be permitted without the express approval of the Court.
