ENDORSED ORDER. Respondents contend that habeas relief is premature at this stage, as Petitioner is currently detained under section 1226, pursuant to a warrant and a notice to appear. (See Dkt. 9 at 1-4; Dkt. 9-1 (evidencing that Petitioner was provided a notice to appear before an immigration judge, which is dated March 19, 2026); Dkt. 9-3 (showing that Petitioner was arrested pursuant to a warrant, which is dated March 19, 2026).) Further, it appears that Petitioner may have a bond hearing before an immigration judge tomorrow morning. (See Dkt. 9 at 2 (explaining that Petitioner requested to have a bond redetermination hearing before an immigration judge); Dkt. 9-1 at 1 (stating that Petitioner has a hearing before an immigration judge on March 31, 2026).) Given the disparate representations in the petition and the response, (compare Dkt. 1 with Dkt. 9), Petitioner must file a reply specifically addressing the facts, arguments, and law raised in the response (Dkt. 9) by noon on April 2, 2026. Further, following tomorrow's hearing before the immigration judge, the parties shall file a joint status report detailing what occurred at the hearing and its impact on the status of this proceeding. Signed by Judge Julie S. Sneed on 3/30/2026. (DM) (Entered: 03/30/2026)

ENDORSED ORDER granting Respondents' motion to file a sur-reply in opposition to the petition for habeas corpus (Dkt. 18). Petitioner contends that habeas relief is appropriate here because Respondents issued the I-200 warrant almost three hours after her arrest. (Dkt. 11 at 2; see Dkt. 9-2 at 1, 3-4 (stating that Petitioner was arrested by Border Patrol agents at 9:30 AM EST on March 19, 2026); Dkt. 9-3 (showing that the I-200 warrant for Petitioner's arrest was issued at 12:11 PM EST on March 19, 2026); see also Dkt. 9-1 at 1, 3 (showing that Petitioner was issued a Notice to Appear on March 19, 2026); Dkt. 9-4 (showing that Petitioner was denied bond and detained by the Department of Homeland Security at 12:12 PM EST on March 19, 2026).) By 5:00 PM EST on April 6, 2026, Respondents must file a sur-reply specifically addressing the facts, arguments, and law raised in the reply, (Dkt. 11), and specifically address Petitioner's argument that the warrant needed to precede her arrest. (Dkt. 11 at 2-3.) To the extent possible, Respondents should provide citations to binding decisions. Signed by Judge Julie S. Sneed on 4/2/2026. (DM) (Entered: 04/02/2026)
