ORDER. First, the petition lists the Southern District of Texas as the Respondent in this case. The Southern District of Texas seems to refer to this Court. However, the proper respondent in a habeas petition is typically the immediate custodian of the detainee, and the immediate custodian of a detainee is the warden of the detention center. See e.g., Lopez-Arevelo v. Ripa, 801 F. Supp. 3d 668, 679 (W.D. Tex. 2025). The Court believes that the petition accidentally named the Court as Respondent and grants leave to amend the petition to modify the named Respondent(s). If naming the Southern District of Texas as Respondent was not an accident, this should be clarified with the Court.Second, in order for someone who is not a lawyer to file a habeas petition on behalf of a detained person, the non-lawyer, referred to as a next friend, must meet certain requirements. Attached is a form that Petitioner, or the person filing the petition on behalf of Petitioner, must fill out.
