ORDER. For the reasons stated in the Court's prior order denying a stay of removal (Dkt. No. 10 ), the motion (Dkt. No. 16 ) is denied. In light of counsel's repeat and deficient emergency filings, the Court orders counsel to review Federal Rule of Civil Procedure 65, as well as the Court's discussion of motions to reconsider the denial of TRO relief in Gaibay- Robledo, 810 F. ORDER. The Court recently granted the petitioner's motion to expedite (Dkt. No. 22) and ordered the parties to submit supplemental briefs addressing the Fifth Circuit's recent decision in Sosnava Rodriguez v. Ortega. Dkt. No. 23 . On July 10, 2026, the Fifth Circuit ordered that the case be reheard en bane and vacated the panel decision pursuant to Fifth Circuit Rule 41.3. Accordingly, the order for supplemental briefing (Dkt. No. 23) is vacated. Pursuant to the order, however, the Court will resolve this matter on an expedited basis and expects to issue a decision in the near future.
