TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Omar Arias Morales, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner, a citizen of Mexico, was detained by U.S. Immigration and Customs Enforcement on March 12, 2026. He alleges that he entered the United States without inspection and has continuously resided here for over 10 years. Petitioner asserts that he is unlawfully detained pursuant to 8 U.S.C. § 1225(b), and that his continued detention violates the Due Process Clause of the Fifth Amendment. (Id.) Having reviewed the Petition and the record presently before it, the Court finds that immediate relief is warranted. Accordingly, it is hereby ORDERED that Petitioner shall be IMMEDIATELY RELEASED from Respondents' custody. It is further ORDERED that Petitioner shall be restored to the legal posture and status he occupied immediately prior to his detention on March 12, 2026. Respondents shall file proof of Petitioner's release on the docket within forty-eight (48) hours of the entry of this Order. A formal written opinion setting forth the Court's reasoning will follow.
