(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner has filed a habeas petition accompanied by an ex parte application for a temporary restraining order (TRO). The Court sets the following briefing schedule for both the ex parte application and underlying habeas petition: Respondents shall respond to both by March 27, 2026; and Petitioner shall file any replies by March 31. The Court continues the TRO hearing to April 3, 2026, at 8:30 a.m. in Courtroom 6C. The Court encourages the parties to consider consenting to the jurisdiction of the assigned Magistrate Judge, which will expedite determination of the petition by avoiding the delay associated with the preparation and review of a Report and Recommendation. By March 27, the parties shall file a joint statement, signed by counsel for each party, stating whether they consent to proceed before the assigned Magistrate Judge for all purposes. Declining consent will not result in any adverse substantive consequences. (In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Respondents represent that they intend to remove Petitioner pursuant to a final administrative removal order under 8 U.S.C. § 1231, that they have obtained travel documents, that they have designated a third country for removal under § 1231(b)(2), that they have served notice of that designation, and that, if Petitioner expresses a fear of removal, they will refer him for protection screening under § 1231(b)(3) and the applicable regulations. The parties shall meet to discuss whether they can agree on the following additional terms: 1. Before removal occurs, Petitioner will be given a meaningful opportunity to raise any fear-based claim for protection. See 8 U.S.C. § 1231(b)(2); Mathews v. Eldridge, 424 U.S. 319, 333 (1976). 2. If Petitioner expresses a fear of removal to the designated country, Respondents shall refer him for appropriate protection screening and proceedings in accordance with 8 U.S.C. § 1231(b)(3) and the applicable regulations governing withholding of removal and protection under the Convention Against Torture. See 8 C.F.R. §§ 208.31, 1208.31, 1208.16-18. Respondents shall afford Petitioner a meaningful opportunity to present such claims and shall not remove Petitioner to that country unless and until those procedures are completed and a final determination has been made that removal is lawful. See id. If the parties agree to include this (or alternative) language in an injunction that would resolve the petition in its entirety, they should notify the Court in a joint statement by 6:00 p.m. today, and the hearing tomorrow will be vacated.
