ORDER TO SHOW CAUSE - The Clerk of the Court shall, before docketing this order, add Justin J. Hall of the Nebraska Attorney General's Office as counsel for Rob Jeffreys in his official capacity as Director of the Nebraska Department of Corrections, and add Assistant U.S. Attorney Christopher L. Ferretti and Assistant U.S. Attorney Eric W. Synowicki as counsel for the respondents, and shall after doing so regenerate the filing for the petition. The respondents shall, on or before March 23, 2026, make a return certifying the true cause and proper duration of the petitioner's detention and showing cause why the writ should not be granted. The petitioner may reply in support of the petition on or before March 25, 2026. The respondents are enjoined from removing the petitioner from the United States and from the District of Nebraska until further order of the Court. MEMORANDUM AND ORDER - The Petition for Writ of Habeas Corpus (filing 1 ) is conditionally granted. The government shall provide the petitioner with a bond hearing pursuant to 8 U.S.C. § 1226(a) and the corresponding regulations on or before March 30, 2026. If the government does not provide the petitioner with a bond hearing as required, the petitioner must be immediately released from detention. On or before April 1, 2026, the government shall provide the Court with a status update regarding the bond hearing or, if no bond hearing was held, advise the Court regarding the petitioner's release. See Michelin v. Warden Moshannon Valley Corr. Ctr., No. 24-2990, 2026 WL 263483 (3d Cir. Feb. 2, 2026); see also, e.g., Velasco Hurtado v. Noem, No. 26-CV-546, 2026 WL 752441 (D. Minn. Mar. 17, 2026); Salazar v. Noem, No. 26-CV-44, 2026 WL 594606 (D. Neb. Mar. 3, 2026); cf. Bah v. Cangemi, 548 F.3d 680 (8th Cir. 2008) (evaluating the merits of immigration habeas petitioner's EAJA claim).
