(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner, proceeding pro se, filed a petition for writ of habeas corpus and an application for a temporary restraining order (TRO). Petitioners TRO application does not comply with the notice requirements in Fed. R. Civ. P. 65, L.R. 65-1, L.R. 7-19.1 and Paragraph 9 of this Courts Civil Standing Order. However, because Petitioner is presently detained and not represented by counsel, compliance with these notice requirements is not practicable. Moreover, pursuant to Appendix C of the Local Rules, Respondents have already been served with the habeas petition and all subsequent filings, and will receive electronic notice of this order. See L.R. Appx C. Accordingly, the Court orders Respondents to respond to the TRO application by March 11, 2026. See L.R. 1-19.1 (permitting court to waive notice requirements for TROs in the interest of justice); cf. Fed. R. Civ. P. 65(b)(1)(B) (permitting court to issue TRO without notice to adverse party if there is sufficient reason for notice not to be required). Failure to timely respond will be construed as consent to granting the TRO application as unopposed. ORDER DENYING APPLICATION FOR TEMPORARY RESTRAINING ORDER by Judge Stanley Blumenfeld, Jr.: Petitioner's Ex Parte Application for a Temporary Restraining Order 2 is denied. The Court sets the following briefing schedule for the underlying habeas petition: Respondents shall respond to the petition by 3/20/2026; Petitioner shall file his opposition by March 27, and Respondents shall file their reply, if any, by April 3. Determination of the petition is otherwise referred to the assigned Magistrate Judge pursuant to General Order No. 05-07. The government shall personally serve Petitioner with a copy of this order forthwith. The parties are encouraged to consider consenting to proceed before the assigned magistrate judge for all purposes, which will expedite determination of the petition by avoiding the delay associated with the preparation and review of a report and recommendation.
