Judge Richard G. Stearns: ELECTRONIC ORDER entered re 13 Response to Petition for Writ of Habeas Corpus - 2241 filed by Kristi L. Noem, Patricia Hyde, Todd Lyons, Michael Krol. Petitioner Raphael Pimenta Franco Morais is a Brazilian national who was taken into U.S. Immigrations and Customs Enforcement (ICE) custody on March 18, 2026. He received a bond hearing in Immigration Court on May 1, 2026, and the Immigration Judge denied Franco Morais's bond request, finding that ICE met its burden of proof to demonstrate that he is a danger to the community by clear and convincing evidence. See Dkt # 13-1 (Order of the Immigration Judge). Franco Marais waived his right to appeal the Immigration Judge's order. Accordingly, this court has no further jurisdiction over this matter. The Clerk will dismiss and close this case.(MZ) (Entered: 05/08/2026)
