PAPERLESS ORDER GRANTING MOTION IN PART. THIS CAUSE comes before the Court upon Petitioner's Motion to Vacate the Court's May 5, 2026 Order, for Issuance of Writ of Habeas Corpus, and for Restoration of Previous Supervision Conditions without Electronic Monitoring. (the "Motion"), ECF No. 15 . In his Motion, Petitioner requests that the Court; (1) vacate its May 5, 2026, Order denying his Petition pursuant to Federal Rule of Civil Procedure 60(b)(3), (2) grant the relief he originally sought in his Petition for Writ of Habeas Corpus, and (3) restore Petitioner's prior Order of Supervision conditions without GPS ankle monitoring. Id. Petitioner notes that the Court's prior ruling relied upon factual representations that Respondents acknowledge were inaccurate. Id. Under Federal Rule of Civil Procedure 60(b), a court may relieve a party from a final judgment, order or proceeding for the following reasons: "(1) mistake, inadvertence, surprise, or excusable neglect; (2) newly discovered evidence; (3) fraud (whether previously called intrinsic or extrinsic), misrepresentation, or misconduct by an opposing party; (4) the judgment is void; (5) the judgment has been satisfied, released, or discharged; it is based on an earlier judgment that has been reversed or vacated; or applying it prospectively is no longer equitable; or (6) any other reason that justifies relief." Fed. R. Civ. P. 60(b).On May 21, 2026, the Court held a hearing on this matter (the "Hearing"). ECF No. 18 . During the Hearing, Respondents noted that they do not oppose the vacatur of this Court's prior ruling. Id. Accordingly, upon due consideration of the Motion, the pertinent portions of the record, and for the reasons stated at the Hearing, it is hereby ORDERED AND ADJUDGED that the Motion is GRANTED in PART as to the vacatur of the previous order. The Court's Order Denying Petitioner's Petition for Writ of Habeas Corpus, ECF No. 11, is hereby VACATED.
